A Bronx man has been arrested after an early morning incident that took place in the City of Elmira.
This morning at around 2:00 am the Elmira Police Department responded to the 400 block of West 4th Street for a report of a subject with a gun. The caller described the suspect as a black male wearing a white t-shirt.
Upon arrival officers made contact with the victim who reported that the suspect had entered his property and began a verbal, then physical altercation with him. It was during this physical altercation that the black male pulled a semi-automatic handgun from his waistband and attempted to fire at him two times. The gun malfunctioned by way of misfires both times. The victim was not injured by the weapon.
The subject then fled the area on foot. The male suspect was apprehended two blocks south of the incident only a few minutes after and was positively identified by the victim.
As a result of the investigation, 35 year old Nathan S. Knox of Bronx has been charged with; Attempted Assault in the First Degree, a Class C Felony; Criminal Use of a Firearm in the Second Degree, a Class C Felony and Criminal Possession of a Weapon Second Degree, a Class C Felony.
Police say evidence recovered at the scene included a misfired bullet, however the weapon has not been located at this time. The public is reminded that if weapons of any kind are located in the area to not touch or otherwise disturb the item and call 911.
